Welcome to Velvet Pour. Please read this Legal Disclaimer & Liability Notice carefully before booking our services. By executing a service contract, paying a retainer, or allowing Velvet Pour to provide services at your event, you (the "Client") explicitly acknowledge, understand, and agree to be bound by the terms, conditions, and operational policies outlined below.
1. Alcohol Procurement & "Dry Hire" Operational Model
Velvet Pour operates strictly as a Dry Hire hospitality service provider. In absolute compliance with state and local beverage control laws:
- Velvet Pour does not hold a retail liquor license, off-premise sales permit, or wholesale alcohol permit.
- Under no circumstances will Velvet Pour sell, resell, retail, or profit from the physical sale of alcoholic beverages.
- The Client retains 100% financial and legal ownership of all alcohol inventory. The Client is solely responsible for purchasing, securing, and legally transporting all alcohol to and from the event venue.
- Any shopping lists, calculators, or consultations provided by Velvet Pour are strictly estimates and do not constitute an offer to sell alcohol.
2. Licensing, Permits, and Venue Compliance
- Compliance: The Client assumes absolute responsibility for ensuring that the event venue permits third-party mobile bar services and the consumption of outside alcohol.
- Documentation: The Client is solely responsible for obtaining any and all necessary special event permits, temporary daily liquor licenses, or host liquor liability policies required by the venue, city, county, or municipality.
- Event Disruption: Velvet Pour shall not be held liable, financially or otherwise, if an event is restricted, delayed, interrupted, or completely shut down by law enforcement, municipal authorities, or venue management due to a lack of proper permitting, documentation, or compliance on the Client's part.
3. Responsible Beverage Service & Right to Refuse Service
All Velvet Pour staff members and bartenders are certified in responsible beverage service protocols (e.g., TIPS, TABC, or local regulatory equivalent). To ensure public safety and mitigate legal risk, our staff reserves the absolute right to refuse alcohol service to any individual at any time who:
- Appears visibly intoxicated, impaired, or incapacitated.
- Acts in an aggressive, abusive, lewd, or unsafe manner toward Velvet Pour staff or other event guests.
- Cannot produce a valid, government-issued photo identification proving they are of legal drinking age (21+).
Operational Safety Rules:
- The bar will close strictly at the contracted time.
- Staff will not serve double shots, straight shots immediately prior to closing, or facilitate activities/games intended to accelerate rapid intoxication (e.g., beer pong, ice luge pours, or drinking games).
4. Limitation of Liability & Indemnification
Velvet Pour maintains comprehensive general commercial liability and liquor liability insurance covering its staff and direct pouring operations. However, by engaging our services, the Client agrees to indemnify, defend, and hold completely harmless Velvet Pour, its owners, employees, and independent contractors from any and all claims, lawsuits, damages, losses, injuries, or legal actions resulting from:
- The consumption of alcohol by the Client or their guests before, during, or after the event.
- Any behavioral incidents, property damage, injuries, or driving incidents (including Driving Under the Influence) caused by guests after consuming alcohol at the event.
- The consumption of alcohol by minors who obtained beverages outside the direct control of the bartender (including, but not limited to, unattended bottles left on guest tables, coolers accessible to the public, or secondary distribution by adult guests).
